INACCORD® is the groundbreaking system for resolving inevitable conflicts. Perfected over the course of thirty years, INACCORD® is entirely unique to Mediators Without Borders®. This system emphasizes transparency, clear balanced communication, and empathy to ensure clients experience an impartial and transformative resolution process. Rather than focus on the specific style of the Alternative Dispute Resolution (ADR) professional, be that facilitative, transformative or directive, INACCORD® shapes the process around the very personal needs of the parties in dispute.
Mediators Without Borders® INACCORD system emphasizes that any dispute must begin in a more informal interview process of conciliation with the conciliator sharing techniques for negotiation. If the parties are unable to work through each of the issues to be resolved and underlying interests to be met, each can seamlessly move to the more formal INACCORD® Mediation process. In a few instances, one or more intractable issues cannot be resolved in a conciliation or mediation process. At this point, any unresolved portions of the dispute are referred to an INACCORD® Arbitrator who reviews the case fact patterns outlined in the conciliation and mediation summaries and renders an award.
Why INACCORD®?
At Mediators Without Borders®, we believe conflict resolution should be entirely focused on the distinct needs of each party to a dispute. Rather than imposing a particular method on each case, the INACCORD® system carefully analyzes the empowerment levels of the parties prior to beginning the actual resolution. If both parties are equally empowered or disempowered -a match in empowerment, they are placed in a room or a Zoom meeting together to work out a solution. If one party is empowered and the other disempowered -a mismatch in empowerment, they begin in separate physical or online rooms until the parties feel equally empowered.
How INACCORD® Works
The system guides disputants through three stages of (1) conciliation, (2) mediation, and if needed (3) arbitration, allowing each party an active role of their own accord, while maximizing satisfaction and understanding.
The three phases of the system include
01.
An initial conciliation meeting to determine suitability for resolution in mediation of arbitration
02.
The 4-stage mediation session
03.
Arbitration hearing/award
TThe information gathered during the conciliation meeting sets the groundwork for a more formal conflict resolution process, if needed. Exit surveys measure changes in disputant empowerment, whether expectations were met, and if the INACCORD process was viewed as fair and impartial.

Ongoing Research
INACCORD® survey data is collected and aggregated to help our team track trends and underscore any changes that may need to be made over time. The information allows us to identify unique aspects for cross-cultural considerations. The data also helps the team adjust the survey instruments and data collection over time to offer disputants historical (a) best alternative to a negotiated agreement, (b) worst alternative to a negotiated agreement, and (c) the most likely settlement.
